Terms of Service

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you and International Ball TV Inc. ("IBTV", "we", "us"), a company based in Toronto, Ontario, Canada. They govern your use of ibtv.io, internationalball.tv and every related IBTV website, application, stream, event booking, membership and Digital Sports Card (together, the "Services").

By creating an account, buying a membership or using the Services, you accept these Terms, our Privacy Policy and, where they apply, our Digital Sports Card Terms. If you do not agree, do not use the Services.

2. Eligibility, youth members and guardians

You must be at least 12 years old to create an IBTV account.

If you are under the age of majority where you live (18 or 19 in most Canadian provinces), a parent or legal guardian must consent to your account and to these Terms, and is responsible for your use of the Services and any purchase made for you. For members aged 12 and 13, a parent or guardian must create or approve the account.

For members under 18: every field beyond the basic profile is optional; social media links are shown only with guardian approval; recruitment, agency and professional contact is routed through IBTV, a guardian, coach, academy or authorized representative; and we never show phone numbers, private email addresses, exact locations or schedules publicly.

3. Your account

Provide accurate information and keep it current. You are responsible for activity on your account and for keeping your login secure. Tell us immediately at team@internationalball.tv if you suspect unauthorized use.

One person per account. You may not impersonate anyone, create an account for someone else without authority, or sell or transfer your account.

4. Memberships, fees and renewals

Annual membership: the price, billing period and included services are shown before you pay (currently CAD $135 per year). Prices exclude applicable taxes (such as GST/HST), which are added at checkout.

A one-time membership is paid once for the number of months shown at checkout and does not renew; you can buy it again when it ends. It is non-refundable once it starts, on the same terms as below.

Your membership is billed in advance for one year and renews automatically each year until you cancel. We will remind you before each renewal. You can cancel at any time under Membership, Manage billing; cancelling stops the next renewal, and you keep your membership until the end of the year you paid for.

Non-refundable: membership fees are not refunded once a membership year starts, including for unused months, because IBTV provides and pays for the services from the first day (hosting, verification and staff review, AI tools, licences and support). We do refund a duplicate or incorrect charge, and the unused part of a membership if we close your account without cause.

A membership is a service. It does not include Digital Sports Cards, points, tokens or anything that can be traded or resold, and it does not guarantee any recruitment, scholarship, contract or job.

We may change prices or features for future membership years with at least 30 days' notice. If you do not agree, you may cancel before your next renewal.

Nothing in these Terms limits any refund or cancellation right you have under the Ontario Consumer Protection Act, 2002 or other consumer law that applies to you.

5. Payments by card and by cryptocurrency

Card payments are processed by our payment provider (Stripe). We do not store your full card number.

IBTV does not accept cryptocurrency today. If we offer it in the future, the accepted assets and network will be shown at checkout together with the amount due. You are responsible for sending the exact amount to the address shown, on the correct network, and for any network fees. Blockchain transactions cannot be reversed by IBTV; payments sent to a wrong address or network may be lost.

A cryptocurrency payment is complete once it is confirmed on the blockchain and verified by IBTV. Approved refunds of cryptocurrency payments are made, at IBTV's choice, in the same asset and amount received or in the equivalent value in Canadian or U.S. dollars at the time of the original payment.

IBTV does not hold, store or manage cryptocurrency on your behalf, does not exchange cryptocurrency, and does not offer any investment, savings or yield product.

6. Digital Sports Cards

A Digital Sports Card ("DSC") is a digital collectible and verified sports-identity card connected to an IBTV member profile. DSCs are governed by our Digital Sports Card Terms, which explain exactly what a DSC holder owns and does not own.

A DSC is not an investment. IBTV makes no promise that any DSC will keep or gain value. Buying, holding or selling a DSC never transfers ownership of, or any rights in, the member, their image, contracts, earnings or professional rights.

7. Your content and the licence you give us

You keep ownership of the photos, videos, resumes, statistics and other content you upload ("Member Content"). You confirm you have the right to upload it, including the consent of anyone shown in it.

You give IBTV a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, format, edit for length and presentation, and distribute your Member Content to operate and promote the Services, including your profile, your Digital Sports Card, highlight reels and IBTV social channels. This licence ends when you delete the content or your account, except for content already shared publicly by others, copies kept in backups for a limited time, and anything we must keep by law.

For members under 18, promotional use beyond your profile and card requires guardian consent.

8. Verification, ratings and rankings

IBTV may verify identity, measurements, statistics, credentials and achievements, and may display a verification level (Self-Reported, Organization Verified or IBTV Verified), ratings, rankings and profile-strength indicators.

These are informational assessments made in good faith from the evidence available. They are not guarantees of ability, recruitment, scholarships, contracts or employment. Ratings and rankings are never influenced by Digital Sports Card prices or trading. You may ask us to review or correct any rating or verification.

9. Recruiting, contact and opportunities

IBTV helps members be discovered. IBTV is not an athlete agent, employment agency or scholarship provider, does not negotiate on anyone's behalf, and does not guarantee any opportunity.

Recruiters, scouts, coaches and organizations must follow the rules of their sport, league, school and governing body (for example NCAA, U SPORTS or FIBA rules) when contacting members. Contact with members under 18 must go through the channels IBTV provides.

10. Acceptable use

You agree not to:

• post false, misleading or unverified claims presented as verified;
• harass, threaten, exploit or discriminate against anyone, or contact a minor outside IBTV's approved channels;
• upload content you do not have the rights to, or private medical information about another person;
• scrape, copy or resell IBTV data or member information;
• interfere with the Services, test their security without written permission, or bypass any access control;
• use the Services for gambling, betting, money laundering or any unlawful purpose;
• present a Digital Sports Card as an investment or promise anyone a financial return.

11. Content standards for creators, hosts and commentators

IBTV content is about sport: games, athletes, coaches and their stories. Content made for IBTV or posted on IBTV channels must not promote political parties, candidates, campaigns or partisan causes, or religious positions, and must not contain hate, harassment or discrimination.

Ratings, rankings, endorsements and coverage are based on verified performance and achievements only. No one can pay for, trade or lobby for a better rating, ranking, endorsement or featured placement.

12. Studio sessions, events and bookings

Bookings for studio sessions, interviews and events are subject to availability and the details shown when you book. You do not need a membership to book a studio session.

A paid studio session is refunded in full if you cancel at least 48 hours before its start time. Cancellations within 48 hours of the start and no-shows are not refunded. If IBTV or the host cancels, or IBTV must reschedule and you do not accept the new time, you get a full refund.

Rule of Two for members under 18: a parent, guardian or another adult they approve is present for the whole studio session, on the call or in the room. Hosts do not record a youth session one-on-one; if no second adult is present, the session is rescheduled.

13. IBTV intellectual property

The Services, the IBTV name, logos, card designs, software, graphics and IBTV-produced media are owned by IBTV or its licensors and protected by law. Except for the rights expressly given in these Terms, no rights are granted to you.

14. Third-party services

The Services rely on third parties such as hosting, payment, login, email, video and blockchain providers. Their own terms apply to your use of them. IBTV is not responsible for third-party services it does not control.

15. Disclaimers

To the extent permitted by law, the Services are provided "as is" and "as available". We work to keep them accurate, secure and available, but we do not guarantee that they will be uninterrupted or error-free. Nothing on IBTV is financial, legal, medical or investment advice.

16. Limitation of liability

To the extent permitted by law, IBTV is not liable for indirect, incidental, special or consequential damages, or for lost profits, opportunities or data. IBTV's total liability for any claim relating to the Services is limited to the amount you paid IBTV in the 12 months before the claim, or CAD $100 if greater.

These limits do not apply where the law does not allow them, including any rights you have as a consumer that cannot be waived.

17. Indemnity

If you use the Services for business purposes, you agree to indemnify IBTV against claims arising from your Member Content, your breach of these Terms or your violation of anyone's rights.

18. Suspension and termination

You may close your account at any time. We may suspend or close an account that breaches these Terms, puts other members (especially minors) at risk, or where the law requires it. Where reasonable, we will give notice and an opportunity to respond. If we close your account without cause, we will refund the unused part of any prepaid membership.

19. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Toronto, Ontario have jurisdiction, without preventing you from using the courts or consumer-protection rights of the place where you live where the law gives you that right.

If you live in Québec, the mandatory consumer-protection rules of Québec apply, and a French version of these Terms is available on request.

20. Changes to these Terms

We may update these Terms. We will post the new version with its effective date and, for material changes, notify members by email or in the Services at least 30 days in advance. Continuing to use the Services after the effective date means you accept the updated Terms.
